How Amanda Lollar of Bat World Sanctuary served me with the lawsuit.

This really shows her true nature. I should have known it was Lollar when the guy said "albino." Lollar is obsessed with albino bats.

In her original complaint Lollar states "Defendant, Mary Cummins, is an individual residing in the State of California andmay be served with process at 645 West 9th Street, #110-140, Los Angeles, California 90015." She could have mailed me the complaint but she did not. Instead she decided to play a very nasty trick on me.

A man emails me about a baby albino squirrel that needs help. He talks about leaving it in his car when it was 105 degrees or maybe giving it to animal control. He was basically saying "come and get it or it will die." Of course I go to get the baby squirrel.

I wasn't sure who to contact but a friend of my daughters' told me about this site. We found a little whitish squirrel at the park, kinda weird has pink eyes. He moves kinda slow, not sure if he is hurt or sick. Didn't know what to do as crows were trying to attack it, so we very carefully put him in a box with out touching him. He / She did not even try to get away. I can't keep him but hate to give him to the animal control, they might kill it. Let me know if this is something you can help with.

Okay, I have given my daughter your instuctions for care of the squirrel. Can we meet around 2:30 p.m. to 3:00 p.m. off the 5 at Carmenita Road. There is a motel 6 parking lot at the corner of Carmenita and Excelsior. If you can not meet at this time I can meet you later after my meeting but I hate to leave him in the car that long. It's kinda hot already today.

A man shows up in a big white SUV, not a Toyota Corolla. His license plate doesn't say "Toyota of Fullerton." With a huge grin he asks me if I'm Mary Cummins. I say "yes" then he pulls his SUV around so he's now between me and the exit.

He gets out and pops the back of his SUV. I see a cage in there so I get out though I still sense something is really not right. He motions me closer until I'm leaning into the back of his SUV. He pulls paper out of a cage and says "you've been sued."

I said "What the F***? I have a serviceable address. Why did you drag me way the f*** out here? Go F*** yourself!"

He said "did you just tell me to go F*** myself?" then he starts coming toward me fast. I hop in my car, zoom around his car and leave.

It took me an hour to drive there and 1.5 hours to drive back. Not only do I have a serviceable address but I was going to adoption events every weekend to find a home for Buddy. I posted the time, address of the events. I could have been served there instead of being forced to drive to Santa Fe Springs.

I'm pretty sure Lollar planned it all, a very nasty trick indeed. It just goes to show her character that she would play such a trick on an animal rescuer just to be mean.

UPDATE: May 11, 2011. Lollar just posted video of me being served. It proves everything I just wrote. You see stupid me getting out of my car with a pet carrier. You see me look into the back of his white SUV. You can even see me mouth "what the f***?" and "yes, I do have a serviceable address." When the man came toward me fast he was on the back side of his SUV as the camera panned left to look at me. I bet he panned left so you wouldn't see the guy coming after me. Plus, the guy knows he's being videotaped. He's not dumb enough to do something on camera. I think this is also why the audio is missing. She claims she tried to serve me for two months. No, she didn't. I posted every adoption event I attended every weekend on public Animal Advocates. I told people to drop by and say "hi." No one asked to meet me. My p.o. box can indeed receive service for me. When you have a UPS p.o. box you must sign an agreement which states they can legally receive service from anyone in any state.

I did some research on video rules. The video is not legal. We were both trespassing on private property which was no longer acting as a commercial business. There were "do not trespass" signs on the property. In order to videotape on private property it must be a commercial business open to the public. The motel is shuttered. They would need permission from the owner to film there. The person filming was in a car parked on the property illegally. A sign said "parking only for motel 6." I contacted the motel. They did not give anyone permission to be on their property or film on their property. Process server broke the law.

Just did more research. In California a process server may trespass onto the person's private property to server them. They are not allowed to trespass onto someone else's property to serve the person. This was illegal service. The process server was trespassing onto the commercial property which was shuttered. There were no trespassing signs all over.

The video in question was removed by PhotoBucket. Because the video was illegal, it was a violation of the terms of service.
